THE DIFFERENCE BETWEEN SEPARATION AND DIVORCE
Separation occurs when a couple stops living together as a married or de facto couple. Divorce is the formal legal process that officially ends the marriage. In Australia, you must have been separated for at least 12 months before you can apply for a divorce. Importantly, divorce itself does not deal with parenting arrangements or property settlement — those are handled separately.
THE DIVORCE PROCESS – STEP BY STEP
- Confirm you have been separated for 12 months
- Prepare and file the divorce application with the Federal Circuit and Family Court of Australia
- Serve the application on your former partner (if required)
- Attend any necessary hearings
- Receive the divorce order (usually finalised within a few months of filing)
